• Vendor: A registered individual or business that lists and sells food or farm-related products via BAYE FoodMart.
• Shopper: A user who browses, orders, and purchases products through BAYE FoodMart.
• Platform: The BAYE FoodMart mobile app, web application, and associated digital tools.

2. General Terms (Applicable to All Users)

• Users must be at least 18 years old or have legal parental consent to use the Platform.
• All users agree to provide accurate, up-to-date, and complete information during registration and transactions.
• BAYE FoodMart reserves the right to suspend or terminate accounts that violate these Terms.

3. Vendor Terms

By registering as a Vendor, you agree to:

• Only list legal, safe, and permitted food or agricultural products.
• Ensure your listings are accurate, with correct prices, product descriptions, and availability.

3.2 Quality Assurance

• Adhere to BAYE FoodMart’s quality and safety standards, including hygiene, labeling, and packaging.
• Submit to regular checks, ratings, and compliance reviews.

3.3 Order Fulfillment

• Fulfill orders promptly and professionally.
• Update product availability and stock levels as necessary.

3.4 Fees & Commissions

• Agree to applicable commission fees and payment schedules as outlined by BAYE FoodMart.
• BAYE FoodMart reserves the right to update fees with prior notice.

3.5 Vendor Conduct

• Refrain from fraudulent activity, manipulation of ratings, or harassment of shoppers.
• Respect data privacy and do not misuse customer information.

4. Shopper Terms

By registering as a Shopper, you agree to:

• Use the Platform to make genuine inquiries and orders.
• Provide accurate delivery and contact information.

4.2 Order & Payment

• Orders are binding upon checkout; payments must be made using approved payment methods.
• You may cancel or request refunds in accordance with the Refund and Cancellation Policy.

4.3 Reviews & Ratings

• Leave honest feedback and product reviews.
• Avoid abusive, defamatory, or misleading content.

5. Data Protection & Privacy

• BAYE FoodMart complies with Kenya’s Data Protection Act and ensures user information is secure.
• Personal data is collected only for purposes of service delivery, verification, and communication.

6. Intellectual Property

• All Platform content (logos, designs, data, and software) remains the property of BAYE FoodMart.
• Users may not copy, reproduce, or exploit any Platform content without prior written consent.

7. Limitation of Liability

• BAYE FoodMart is a facilitator and does not guarantee the availability, quality, or performance of third-party products.
• We are not liable for losses or damages arising from delays, misuse, or negligence by vendors or logistics providers.

8. Suspension & Termination

• BAYE FoodMart reserves the right to suspend or terminate any user account for breach of these Terms or suspected illegal activity.
• Vendors with repeated violations may be permanently removed from the Platform.

9. Modifications

• BAYE FoodMart may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated terms.

10. Governing Law

• These Terms shall be governed and interpreted in accordance with the laws of the Republic of Kenya.
